to those elements is the sole property of The Trinity Trike Mfg. LLC or its
licensors, and is protected by U.S. copyright laws and international treaties.
Except for the limited use licenses expressly granted to you in this Disclaimer
document, The Trinity Trike Mfg. LLC reserves for itself and it's licensors
all other rights, title and interest.
Without limitation on the foregoing, you may not reproduce,
modify, display, sell, or distribute The Trinity Trike Mfg. LLC design, literature
or website(s) content, or use it in any other way for public, private or commercial
purposes. This includes copying or adapting the HTML code used to generate trinity
web pages. The Trinity Trike Mfg. LLC design logos and certain other names or
logos are service marks or trademarks of The Trinity Trike Mfg. LLC. Other companies
product and service marks contained on our website(s) and in the sales and other
descriptive literature are the trademarks of their respective owners.
Changes, Errors & Inaccuracies:
The Trinity Trike Mfg. LLC reserves the right to update
or modify the terms and conditions at any time without prior notice. Improvements
to products may result in unannounced changes to specifications and external
appearance. We strive to list and advertise all text and product information
as accurately as possible. However, unforeseen typographical errors, photographic
errors and inaccurate information on the Trinity website or sales literature
may occur. We reserve the right to correct any errors, inaccuracies or omissions
and to change or update information at any time without prior notice, including
order that have already been submitted. If such errors occur, we apologize for
any inconvenience.
The Trinity Trike Mfg. LLC has multiple manufacturing
sources that supply components of our products; therefore the actual model shipped
may have different manufacturer name and model number. Note however that the
product model and specifications will be similar if not the identical.
Assembly:
All Trinity Trike vehicles require some assembly. Any
Trinity Trike conversion is still a motorcycle and must be licensed and registered
as such. Driver and passengers should wear helmets and the same protective gear
that motorcyclists do. A Trinity Trike conversion vehicle offers no more frontal
or side impact protection in an accident than an ordinary motorcycle, so use
safe motorcycle riding strategies when operating a Trinity trike conversion.
Each vehicle is unique and will have different assembly
requirements. A Trinity Trike conversion to a vehicle can often be assembled
by skilled customers and professional technicians within 3 or 4 hours depending
on the donor vehicle. Although assembly is straight forward, we require you
have a certified automotive or motorcycle technician complete your assembly
unless you have signed a waiver (provided separately upon request). Therefore,
installation of components, assemblies or "kit conversions" to modify
a motorcycle and make it into a trike should only be undertaken by persons experienced
in the installation and proper operation of modern motorcycle vehicle systems.
It is the responsibility of the person installing any such components or assemblies
to determine the applicability or suitability of those components for that particular
vehicle and/or application. Any and all vehicle, equipment, drivetrain and brakes,
must be properly maintained after conversion and should be checked regularly
for snug fit, component fatigue, damage and wear. Certain vehicles may not include
detailed assembly instructions or manuals.
Cancellation Policy:
All orders are processed on a first come, first served basis. If The Trinity Trike Mfg. LLC is installing the conversion components, and production on your order has begun, it cannot be canceled without suffering a 20% cancellation fee and incurring whatever parts and labor costs it might take to "restore" the donor bike to it's original condition. If the order is for an off the shelf component assembly and it has been shipped and you still wish to cancel it, you will be charged a 20% cancellation fee and crating and shipping costs both ways. Finally, if the cancellation is made prior to any significant preparation, the cancellation fee is only 5% to cover the administrative costs involved. Therefore, please be certain of your order before actually placing one as there are minimum processing fees assessed on each order. All cancellations must be submitted to us in writing via email or fax.
Privacy Policy:
Although The Trinity Trike Mfg. LLC collects for it's
use information about our online guests via the internet, if we receive and
may store any information you enter on our website or give to our website in
any way, this is to help improve our service to you. We will not share your
information with any vendors, business partners or other organizations except
when and where it is required to fulfill your order. We may disclose certain
appropriate information about you to comply with the law; to protect the rights,
property or safety or our website, our users or others. We recognize the importance
of protecting privacy where children are involved. We do not knowingly collect
personal information from children under the age of 18. If a child has provided
our website with personal identifiable information, we ask that the parent or
guardian contact us so we can delete the information about the child. By using
out website, you consent to our use of information that is collected or submitted
as described in our online privacy policy. We may change or add to this privacy
policy so we encourage you to review our policies periodically.

Waiver of Liability:
Under US DOT regulations, motorcycles, trikes and variations thereof are considered as "extreme sports class" vehicles and injuries occurring during their operation are solely the rider's responsibility except in cases involving "deceptive manufacturing." Under DOT rules, deceptive manufacturing is defined as a deliberate substitution of used parts for new components or selling non-DOT regulated vehicles.
Motorcycle operator who exceed the weight limit set by
the manufacturer of the motorcycle are solely responsible for any injury or
error.
Purchasers must recognize and understand that drivetrain parts and equipment,
such as chains, belts, gears, disc brakes, hubs, etc. and all assembling parts,
are exposed to many and varied conditions due to the manner in which they are
installed and used. Purchasers and The Trinity Trike Mfg LLC consciously desire
to make their own bargain, irrespective of any court decision and purchasers
agree upon good faith and in consideration for being allowed to purchase from
The Trinity Trike Mfg LLC said assemblies or services.
Purchasers expressly acknowledge and understand that The Trinity Trike Mfg LLC does not make any affirmation of fact or promise to purchaser, which relates to said assemblies, inventory, or services that becomes part of the basis of the bargain between The Trinity Trike Mfg LLC and said purchasers. Nor does The Trinity Trike Mfg LLC make, or cause to be made to purchaser any description of the goods sold to purchaser, nor does The Trinity Trike Mfg LLC make, or cause to be made, as part of the basis of the bargain with purchasers, any description or affirmation of fact concerning any sample or model of conversion parts, and equipment inventory or service.
As further consideration for purchasers using The Trinity Trike Mfg LLC assemblies and equipment any and all inventory and services, purchasers acknowledge that due to the differing conditions and circumstances under which all equipment and parts are installed and used, purchasers are not relying on The Trinity Trike Mfg LLC skill or judgment to select or furnish the proper part or equipment. Purchasers expressly affirm they are relying upon their own skill or judgment to select and purchase suitable goods.
The Trinity Trike Mfg LLC makes no warranties whatsoever, expressed or implied, oral or written, to purchasers. There is no warranty of merchantability made to purchasers. The Trinity Trike Mfg LLC further excludes any implied warranty of fitness with respect to trike conversion equipment, any and all inventory and service.
It is expressly understood and agreed between purchasers and The Trinity Trike Mfg LLC that as part of the bargain between The Trinity Trike Mfg LLC and purchasers, and in consideration of doing business with each other, all purchasers take, select and purchase said trike conversion parts, equipment, any and all inventory, or services from The Trinity Trike Mfg LLC "as is" and "with all faults." The Trinity Trike Mfg LLC shall always provide purchasers with a full and complete opportunity to examine, at the purchasers' leisure and convenience, any trike conversion parts and equipment, any and all inventory, or services when purchasing or contemplating purchasing from The Trinity Trike Mfg LLC.
If, and in the event that purchasers expressly or impliedly cause representations, or statements or affirmations of fact contrary to this disclaimer of all warranties, expressed or implied, then purchasers agree to indemnify and hold harmless The Trinity Trike Mfg LLC in the event of any claim, demand, or legal action against The Trinity Trike Mfg LLC by any purchaser.
Notwithstanding the above disclaimers, The Trinity Trike Mfg LLC may at it's election replace free of charge any part deemed to require it during the first 12 months of the original purchaser's ownership.
Purchasers understand and agree that no officer, director,
employee, or salesman of The Trinity Trike Mfg LLC has any authority to make
any statement contrary to the terms of this agreement. On the contrary, The
Trinity Trike Mfg LLC disavows any such statement contrary to what is herein
above written.
